The Purpose of Business Rescue legislation is to afford a financially distressed company โlegal protectionโ in order to rehabilitate and then continue to exist on a solvent basis or result in a better return for the creditors as opposed to a liquidation. To test whether a company is eligible for Business Rescue is either it appears to be reasonably unlikely that the Company will be able to pay all of its debts, as they become due and payable within the immediate ensuing six months or it appears to be reasonably likely that the Company will become insolvent within the immediate ensuing six months.
